Authority and Obligations of S.L. Oceanview Villa Rentals Ltd
The Owner hereby appoints S.L. Oceanview Villa Rentals Ltd as his lawful rental agent with full authority to do any and all lawful things necessary for the fulfillment of this Agreement, including the following:
1. To advertise the availability of the Property for rent by placing signs on or near the Property, advertising in media sources, including but not limited to local newspaper.
2. To promote the Property through third parties such as tour operators and travel agencies.
3. To collect rents and security deposits or other charges and expenses due or to become due and to give receipts therefore. To deposit any receipts in an account in S.L. Oceanview Villa Rentals Deposit Account.
4. To hold the master calendar for the Property and to notify the owner, via SMS, when a new booking is added, amended or cancelled. The Owner can view the master calendar on the online reservations system calendar, maintained by S.L. Oceanview Villa Rentals Ltd.
5. If an S.L. Oceanview Villa Rentals Ltd client cancels, at any time, their rental agreement, the deposit is kept by S.L. Oceanview Villa Rentals Ltd for administration costs. If a renter cancels 30 days prior to their arrival, S.L. Oceanview Villa Rentals Ltd will endeavor to collect the monies from the renter and 75% of the total collected will be paid to the Owner, but S.L. Oceanview Villa Rentals Ltd cannot be personally held responsible for No Shows and accepts no liability.
6. If the Property Owner has subscribed to S.L. Oceanview Services Ltd, the sister property management company of S.L. Oceanview Villa Rentals Ltd, all call-outs by any guests will be taken care of by Oceanview's employees Free of Charge.
7. S.L. Oceanview Villa Rentals Ltd will not be held responsible for cosmetic or consumable damage to items in the Property; this is due to wear and tear.
8. In the event of malicious damage to the Property by the renter, S.L. Oceanview Villa Rentals Ltd will do their utmost to recover the cost from the security deposit and if necessary through the Courts, but S.L. Oceanview Villa Rentals Ltd cannot be personally held responsible and accepts no liability.
9. If clients have to be moved from the Property during their stay, S.L. Oceanview Villa Rentals Ltd will not pay any rental money or compensation to the Owner for the nights unoccupied.
10. At the end of a season S.L. Oceanview Villa Rentals Ltd may issue the Owner with a report of necessary maintenance/upgrades to the Property and the Owner has until 31st December to provide, in writing, to S.L. Oceanview Villa Rentals Ltd, acceptance that the work will be completed by 1st April, otherwise S.L. Oceanview Villa Rentals Ltd will take the Property off its websites and penalties will apply.
11. To maintain accurate and complete accounting records of all money received and disbursed in connection with the rental of the Property. The Owner can view or print copies of monthly statements via the online owner area.
12. S.L. Oceanview Villa Rentals Ltd agrees to pay the Property Owner the agreed rent for each booking, based on the Property having in good working condition all of the facilities and equipment that were at the Property (or agreed to be at the Property) and/or as specified in the agreed inventory, at the time of this agreement being made and as subsequently advertised on our website, which will form part of the booking contract between S.L. Oceanview Villa Rentals Ltd and the Owner.
13. S.L. Oceanview Villa Rentals Ltd agree to pay the Owner at the agreed rate/s (defined below in paragraph 35) or as varied from time to time in writing, by mutual agreement. Please note that once rates have been agreed, should they subsequently be changed, that the agreed change in rate will only apply to any new bookings made.
14. Payments to the Owner will be made for each booking within the first 7 days of the month following the guest's arrival.
15. Payments will be made by bank deposit only. Payments can only be made into a local (Cyprus) bank account, in Euros.

Obligations of Owner
In consideration of the foregoing undertaking by S.L. Oceanview Villa Rentals Ltd, Owner shall:
16. If the Owner decides to advertise their Property themselves or with other agents they can NOT use the photographs that S.L. Oceanview Villa Rentals Ltd have taken of their Property. The Owner is free to use any international advertising sites to advertise their Property themselves and all the Owner agrees to, is to set the rental tariffs at the same rate as all the other websites that they advertise on.
17. Notify S.L. Oceanview Villa Rentals Ltd immediately of any factor that may affect the guest's quiet enjoyment of the property i.e. building work, noise, broken equipment/facilities etc and in such situation S.L. Oceanview Villa Rentals Ltd reserves the right to either cancel any booking/s made or reimburse the guests a percentage of the rent paid, as deemed by S.L. Oceanview Villa Rentals Ltd fair and appropriate.
18. Upon notification of a booking from S.L. Oceanview Villa Rentals Ltd, the owner agrees to notify S.L. Oceanview Villa Rentals Ltd within 24 hours of the advice if the booking cannot be accepted for any reason. If no notification of a declined booking is received, then booking deemed confirmed after 24 hours. Cancellation of a booking at a later date may result in compensation payable to S.L. Oceanview Villa Rentals Ltd and/or the guest.
19. Once the Property Owner accepts a booking from S.L. Oceanview Villa Rentals Ltd, the Property Owner agrees that they will hold the Property exclusively for S.L. Oceanview Villa Rentals Ltd and will not let it to anyone else, during the booking period.
20. The Property Owner agrees to notify S.L. Oceanview Villa Rentals Ltd immediately of any dates that the Property will not be available via Oceanview's online owner area only. No emails or phone calls will be accepted.
21. In the event of a double booking, S.L. Oceanview Villa Rentals Ltd clients will always take precedence.
22. To notify S.L. Oceanview Villa Rentals Ltd immediately/but at least 7 days prior notice of any Owner bookings or 3rd party arrivals and to make sure that the calendar of the Property is accurate at all times. The notice must include: the party leader name, party numbers, e-mail address, phone number for Emergency use, date and time of arrival and departure. All bookings can only be made if the Property is free for the period required. The Owner agrees to pay S.L. Oceanview Villa Rentals Ltd liquidated damages for any booking cancelled or curtailed by the Owner after S.L. Oceanview Villa Rentals Ltd has accepted such bookings on the Owner's instruction, or where the Property is in an unfit state for whatever reason (other than S.L. Oceanview Villa Rentals Ltd's default or force majeure as defined). Any Owner booking not on the master calendar will not be deemed as a valid booking and the dates will be viewed as available. Any double booking taken in this instance by S.L. Oceanview Villa Rentals Ltd will be viewed as a double booking made by the Owner and clause 21 above will come into effect.
23. If the Owner cancels an S.L. Oceanview Villa Rentals Ltd booking more than 7 days after the booking date, the Owner is liable to pay 20% of the rental value. 180 days prior to arrival, the Owner is liable to pay 30% of the rental value. Less than 90 days prior to arrival, the Owner is liable to pay 50% of the rental value, to cover the cost of an upgrade plus compensation for the renter.
24. If an Owner's guest contacts S.L. Oceanview Villa Rentals Ltd by any means before their arrival date for any reason whatsoever, the Owner will be charged EUR 25.00 each time. (These are your guests and therefore you must liaise with them).
25. In the event of a guest's arrival being at night, the Property Owner agrees to leave switched on an outside light. The Property Owner agrees to have the Property ready for the guest, which means everything in working order, and clean, including made up beds with clean bed linen, towels, floors, clean windows and outside areas including swimming pool, verandas, driveways, terraces and all gardens. If there is a swimming pool at the Property, the Property Owner agrees to clean it and maintain it as and when required, but no less than 2 times per week in High season (1 Apr - 30 Oct). If a booking exceeds 9 nights, then the Property Owner agrees to clean the Property at least every 7 days (unless otherwise agreed in writing) to include changing the bed sheets and towels. If the Property Owner does not have existing cleaning services, they can take up the option of the services provided by S.L. Oceanview Villa Rentals Ltd sister company, S.L. Oceanview Services Ltd. S.L. Oceanview Villa Rentals Ltd standard check in time is from 5pm and check out by 10am.
26. During the guest's stay at the Property, the guest will have the Property Owner/Manager's telephone number/s and the Property Owner agrees to attend immediately to any defects or problems found with the Property during the guest's' stay. On all our websites, your Property will be advertised that it is not maintained or managed by S.L. Oceanview Services Ltd.
27. The Property Owner agrees to sympathetically deal with and respond promptly to any complaints received from guests whether received directly or via S.L. Oceanview Villa Rentals Ltd. In the event of the guests making any claim for compensation due to any fault with the Property, its services or agreed facilities, the Property Owner agrees to reimburse the guests an agreed amount and/or for S.L. Oceanview Villa Rentals Ltd to deduct an agreed amount from the Property Owner's future rental payments. The Property Owner agrees to indemnify S.L. Oceanview Villa Rentals Ltd against any such claim.
28. The guests introduced to the Property Owner, by S.L. Oceanview Villa Rentals Ltd will remain the guests of S.L. Oceanview Villa Rentals Ltd at all times. If the guests approach the Property Owner directly to re-book the Property for another period, the Property Owner must refer the guests to S.L. Oceanview Villa Rentals Ltd. In the event that a Property Owner accepts a booking from one of S.L. Oceanview Villa Rentals Ltd's guests directly, this agreement will immediately be terminated by S.L. Oceanview Villa Rentals Ltd and the Property Owner will be charged by S.L. Oceanview Villa Rentals Ltd a sum representing the loss of commission based on the length of time that the guests have rented the Property together with any other losses incurred.
29. It is the Owner's responsibility to ensure that any necessary licences, consents and permissions applicable by law relating to the Property are obtained. It is the Property Owner's responsibility to ensure that at all times the Property complies with all applicable laws, regulations and codes of practice in terms of health and hygiene, fire safety etc and if required ensure up to date records and certificates are kept. We strongly recommend that the Property Owner takes out adequate property insurance to cover all normal perils including accidental damage, third party liability, public liability and comply with EU Health and Safety standards.
30. Health & Safety. The health and safety of our guests is of paramount importance. It is therefore required that Property Owners ensure that their properties maintain safe for guest use at all times.
31. Precautions should include:
  • Ensuring balconies and terraces have suitable safety railings.
  • Ensuring that any upper floor windows that are accessible from low level (for example by a child) cannot be opened without the use of a key or a tool.
  • Ensure that there are no broken paving stones or obstacles in the garden particularly around the swimming pool area where it is likely that persons will be walking bare foot, so as to ensure that they do not trip and fall.
  • To ensure that there are protective hand rails or railings wherever there is a change in levels where one could fall.
  • Ensure that there is sufficient lighting and working light bulbs for lights at night so as to ensure that guests can safely see where they are walking.
32. Inside the property ensure that the property is equipped with suitable safety equipment including the following items:
  • A first aid box.
  • 2 smoke/fire detectors.
  • A fire extinguisher.
  • A fire blanket.
  • Ensure that safety stickers are fitted to all glass patio doors.
33. Outside there should be available the following items:
  • A swimming pool Rules sign to state "Swimming Pool Rules" as follows "No Diving, No Running, No Glassware and Children must be supervised at all times"

34. Indemnify and hold S.L. Oceanview Villa Rentals Ltd harmless from any and all costs, expenses, solicitors fees, suits, liabilities, damages from or connected with the rental of the Property by S.L. Oceanview Villa Rentals Ltd or the performance or exercise of any of the duties, obligations, powers and authorities herein or hereinafter granted to S.L. Oceanview Villa Rentals Ltd, and from any liability for injury on or about the Property which may be suffered by any employee, tenant or guest upon the Property, except where such act or omission is a result of willful misconduct or gross negligence on the part of S.L. Oceanview Villa Rentals Ltd or employees of S.L. Oceanview Villa Rentals Ltd.
Agreed Rent
35. S.L. Oceanview Villa Rentals Ltd agrees to pay the Owner as the rent per week as per the Agreement Contract.
Assignment
This Agreement may not be assigned by S.L. Oceanview Villa Rentals Ltd or Owner without the prior written consent of the other. In the event, however, such consent is granted and the Agreement is assigned, each of the covenants, conditions and obligations contained herein shall be binding.
Notification
S.L. Oceanview Villa Rentals Ltd reserve the right to make changes/amendments to our procedures or the terms & conditions in this agreement at anytime and at our sole discretion. You will be notified of any such changes in writing. If you are not in agreement with the changes/amendments then you have the right to terminate this agreement in accordance with the termination clause. Continued participation in the programme following a change/amendment will constitute acceptance of the change.
Termination
36. If any sum hereby agreed to be paid by the OWNER to S.L. Oceanview Villa Rentals Ltd or in any part thereof shall remain unpaid for a period of one month after the same shall have become due, S.L. Oceanview Villa Rentals Ltd may give the OWNER 14 days notice to terminate this agreement. This agreement shall upon expiration terminate absolutely and S.L. Oceanview Villa Rentals Ltd obligations herein shall cease but without prejudice to the liability of the OWNER in respect of such or any other breach of this agreement.
37. In the event any term or provisions of this Agreement shall be invalid or unenforceable, then the remainder of this Agreement shall not be affected thereby and each term and provision shall remain valid and enforceable to the fullest extent permitted.
38. Either party reserves the right to terminate this agreement at any time after the first twelve months of the contract enforcement date by providing the other party 90 (Ninety) days notice.
